Resumen
This work aims to give a reflection and the construction of an interpretation from the historical hermeneutical paradigm perspective in order to produce comprehension processes concerning to the social phenomenon of the education as a matter of commercialization. The economic opening and the world economic system reforms promoted the need for modernization to the country’s productive apparatus based on the formulation of a wide political and legal framework in 1991, since then education is recognized as a fundamental right in Colombia. This process was accompanied by the new information and communications technology arriving, where e-learning education and the franchising system made up a business model which is settled in the educational market of the country as an option or strategy for economic development. As a result, this relationship influences the guarantee of right to education by linking access and quality to the individual financial capacity.
