The Capital District has type A transfer areas located in Neighborhoods and Urbanization subject to Horizontal Property Regulations, which for reasons that has not been established yet, those have not been delivered to the municipality, generating that these public spaces such as parks, green areas and some roads premises are breaching the pre-established social function and the norm, since they are being used by individual persons. We carried out a brief verification and analysis on the subject in in the Zonal Planning Unit No. 88 El Refugio, Chapinero, as a specific case the residential área, “the Hunzahua Multifamily Housing Group” or “Los Farallones Del Moro Building”, at Transversal 4A No. 87 - 90 and Carrera 4 No. 87-97.
This work showed national and local regulations (Legal Framework) that clearly define the problem of Chapinero, Bogotá. It informed how the information was obtained (carried out in the field and office), search for relevant information to demonstrate the irregularities. Finally, a quantification of the Patrimonial Detriment was carried out applying appraisal methodologies (Market and Income) in addition to other economic valuations which could demonstrate the hypothesis proposed.
