Resumen
The objective of this monograph is to characterize and analyze conflicts over collective land tenure in Colombia, considering the origin of the creation of Indigenous reserves during the Spanish colonization, the legal frameworks that have enabled the recognition of territorial rights, and the interethnic conflicts that influence land management within these territories.
The analysis focuses on information available up to 2023, with an emphasis on territories that remain unformalized. Both official and unofficial sources were utilized to identify areas experiencing land tenure conflicts.
The findings indicate that land tenure conflicts stem from socio-historical processes, such as colonization and armed conflict, as well as internal territorial disputes and the Colombian State's failure to protect territorial rights. Additionally, the study concludes that, in some cases, state institutions exacerbate these conflicts by granting land titles in territories belonging to other Indigenous communities or peoples.
Finally, the monograph recommends further research into intercultural conflicts involving Indigenous, Afro-descendant (NARP), and peasant communities.
