Del Imaginario del Derecho a la Educación a las Prácticas del Servicio

Abstract

The work refers to the role played by the right of protection in the guarantee and protection of the right to education in Colombia because despite having been recognized as a fundamental right by the Constitutional Court. it was not regulated by a statutory law. Likewise, this right was defined as a service that converts it a commodity; hence, whoever wants quality education must pay for it. Precisely, through the use of a mixed methodology it was demonstrated that, although the imaginary of education is well configured socially and legally, it is not the State that makes its guarantee effective but the Constitutional Court through the right of protection.
