El Avalúo Comercial Como Instrumento Para Eliminar La Lesión Enorme En La Compraventa de Bienes Inmuebles urbanos entre Particulares

Abstract

The lesion beyond moiety is denaturalized and loses its raison d'etre in the Colombian legal reality if the commercial valuation is established as an essential requirement for the formalization of the sale contract of urban real estate between individuals in Colombian legislation. The commercial valuation is an instrument of unlimited relevance in real estate transactions and that is currently not being optimized inside of the administration of the people´s assets, in the development of the real estate market and into the decongestion of the judicial system, taking into account that today, there are still individuals who are involved in court trials because of the technical imprecisions that occurs in the determining of real estate’s price, concluding, that the commercial valuation has a great capacity to quickly integrate the cadastral and registry institutions.
