Metodología para la aclaración de cabida y linderos de predios rurales

Abstract

The Colombian Institute for Rural Development (INCODER) has the mission to facilitate small and medium rural producers access to land and other productive factors, specifically to give land to the peasants poor or displaced, under principles competitiveness, equity, sustainability and multifunctionality, to help improve the quality of life of rural people and the socioeconomic development of the country, based on the standards developed in the framework of law 160 of 1994, decree 1300 of 2003, decree 4902 of 2007 and currently in force decree 1359 of 2009, as regulatory support in land acquisition processes promoted by the inhabitants of the rural sector. Explicitly Article 4 of Decree 3759 of 2009, assigns specific functions INCODER granting direct subsidies through competitions through transparent public calls that will serve selection criteria with the presentation of the financial, environmental, technical production project and socially viable for land acquisition. The assistant manager of management and production development, according to paragraph 7 of Article 18 of Decree 3759, aims to identify and verify with certainty the minimum requirements of the beneficiaries and the land intended to be acquired. In this process the assistant manager uses the Protocol clarification fit and boundaries, to clarify the purchase of such premises. The above protocol indicates that you must have at least three inputs base, consisting of a productive project, a topographic map and commercial appraisal, in order to comply with the conditions set out in the regulatory and legal framework, in order to facilitate the processing of applications submitted under the public call for granting comprehensive land subsidy. From there, if they find inconsistencies with the registered titles of tradition and property tax identification, it is necessary to compare inputs referrals (topographic maps), with inputs held by the relevant entities in registration materials (Offices of Public Instruments and Geographic Institute Agustín Codazzi (IGAC)), which may be provided to this study, by providing land registry certificates, award titles and purchase it possible to determine accurately the actual area of ​​land covered by the grant award mentioned. Following the order of ideas is seeking to conclude the implementation of the call, INCODER is in the legal and regulatory obligation to make that analysis, in order to accurately identify the boundaries of the properties offered, the actual areas and being necessary to ask the IGAC clarification place and boundaries of the land, prior to the holding of public deeds of sale, in order to complete the procedure for disbursement of the subsidy is not an additional charge for applicants people grant .
