Análisis del avalúo comercial de un predio destinado a la producción de banano tipo exportación, afectado por la construcción de un gasoducto en el municipio de zona bananera en el departamento del Magdalena

Abstract

This case study is based on analyzing the production model of a farm located in a highly banana-producing region such as the department of Magdalena, which has an agricultural vocation dedicated to the large-scale and highly technical production of export-type bananas. This property can be affected by construction work such as the oil or gas pipeline, since according to what is contained in article 1 of Law 1274 of 2009 "The hydrocarbon industry is declared of public utility in its exploration branches, production, transportation, refining and distribution, therefore, the properties must support all the legal easements that are necessary to carry out the activities" (Law 1274, 2009). For this reason, it is necessary to build easements on private land to develop an economic activity from which the nation benefits (such as the transportation of hydrocarbons). However, these works or layouts could affect the productivity of agricultural property and in turn its commercial economic value, which has generated that the appraisal activity in Colombia becomes more important when determining the economic value of the property and calculating fair compensation following the law, this being a right of the owners when they are affected
