Abstract

It is clarified that the provisions of chapter 3 of the law of July 31, 1823, relating to the occupation of properties for public works , are applicable to works undertaken by town councils, municipal councils and provincial chambers. The resolution reaffirms the validity of this law according to the provisions of article 4 of the law of May 4 and article 32 of the law of July 3, which allow the occupation of private property for the construction of works of public utility, as long as the owners are compensated fairly. Thus, it is recognized that these corporations have the authority to carry out said public works and must comply with the regulations established for the compensation and occupation of properties.
