Abstract

The image contains an exposition of the legality of the municipal agreement that creates a body of guards based on the decree that suspends said agreement by the Mayor of the city. The Prefect of the Department has supported the suspension and forwarded the suspended agreement for review. It is highlighted that the suspension is based on the lack of legal promulgation of the municipal agreement, contravening the Political and Municipal Code. It is argued that the suspension is valid only in cases contrary to the Constitution or the law, not due to lack of promulgation. Furthermore, it is noted that the provisions of the Code do not apply directly to municipal agreements, since these are not laws. In this sense, the difference between laws and municipal agreements is highlighted, concluding that the suspension of the guards' agreement lacks legal foundations due to the lack of promulgation.
